Terms of service

These terms govern your use of thetexmart.com and any purchase made through it. The site is operated by Patco Exports Private Limited, a private limited company registered in India, trading as Texmart. In these terms we, us and our mean Patco Exports Private Limited, and you means the person or business placing an order.

By placing an order you accept these terms. Please read them before buying.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract. If you are ordering for a business, you confirm you are authorised to bind that business.

2. Products and descriptions

We describe our goods as accurately as we can. Dimensions, weights and technical specifications are given in good faith and may vary within normal manufacturing tolerances. Photographs are illustrative; colour and finish may differ slightly from the image on your screen.

Our products are industrial goods intended for use by people competent to install and operate them. It is your responsibility to confirm that an item is suitable for your machine and your application before ordering. If you are unsure, contact us before you buy.

3. Prices and taxes

Prices are shown in Indian Rupees and are inclusive of GST unless stated otherwise at checkout. Shipping is charged separately and shown before payment. We may change prices at any time, but a change will not affect an order already confirmed.

Where a price is shown alongside a struck-through figure, the struck-through figure is the maximum retail price or our list price, not necessarily a price at which the item was previously sold on this site.

4. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we confirm dispatch. We may decline or cancel an order, refunding you in full, where the item is out of stock, where a price or description was clearly wrong, where we cannot deliver to your address, or where we suspect fraud.

5. Payment

Payment is taken at checkout through our payment provider. We do not see or store your full card details. Goods remain our property until payment has cleared in full.

6. Delivery

Delivery is covered by our Shipping Policy, which forms part of these terms. Delivery estimates are not guaranteed and time is not of the essence unless we have agreed otherwise in writing.

7. Returns

Returns and refunds are covered by our Refund Policy, which forms part of these terms.

8. Warranty

Goods are warranted to be free from defects in material and workmanship under normal use for the period stated on the product page, or where no period is stated, for six months from delivery. The warranty covers repair or replacement of the defective item at our option.

The warranty does not cover normal wear, consumable parts, damage from misuse, incorrect installation, unauthorised repair or modification, use outside the stated specification, or damage from voltage irregularity or improper storage.

9. Limitation of liability

To the extent permitted by law, our total liability arising out of any order is limited to the amount you paid for the goods in question. We are not liable for indirect or consequential loss, including loss of production, loss of profit, machine downtime or loss of contracts. Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence.

10. Intellectual property

All content on this site, including text, images, the Texmart name and logo, belongs to us or our licensors and may not be copied or used without written permission.

11. Your account and conduct

You are responsible for keeping your account details secure and for the accuracy of the information you give us. You may not use this site for any unlawful purpose, or attempt to interfere with its operation or security.

12. Privacy

Our Privacy Policy explains how we handle your personal data and forms part of these terms.

13. Force majeure

We are not liable for delay or failure caused by events outside our reasonable control, including natural events, strikes, transport failure, power or network failure, and acts of government.

14. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising from them.

15. Changes to these terms

We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.
